1. Who you are contracting with
Sprout & Spark ("we", "us") operates the website and learning platform at sproutandspark.app. By creating an account or continuing to use the service, you agree to these terms. If you are using the service on behalf of an organisation, you confirm you have authority to bind it; if you are an individual, you confirm you are of legal age to enter this agreement. Sprout & Spark is intended to be used by children under the supervision of a parent, guardian or teacher, who is the account holder.
2. What we provide
Interactive science challenges, simulations, illustrated stories, animated fables, hints, badges and progress tracking, available through a free tier and a paid Standard plan that unlocks all content for one year.
3. Your account
Provide accurate information and keep it up to date. Keep your login credentials confidential — you are responsible for activity under your account.
4. Acceptable use
You must not:
- use the service unlawfully, or for fraud, spam or abuse;
- infringe anyone's intellectual property rights;
- interfere with the security of the service — no malware, probing, scanning, scraping or circumventing technical limits;
- reverse engineer, resell or redistribute the service or its content;
- share account access beyond your own household or classroom.
5. Intellectual property
We own the service, its software, illustrations, videos, text and branding. You get a limited, non-exclusive, non-transferable right to use the service within the plan you have chosen, for personal or classroom learning.
6. Service level
We work hard to keep the service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose. Educational content is provided for learning and is simplified for children; it is not professional advice.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. The Standard plan is a single payment of $20 granting one year of access; it does not renew automatically.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can stop using the service at any time. When access ends you may request an export of your child's progress data within 30 days, after which it may be deleted.
9. Liability
We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where that cannot be excluded by law. You indemnify us against claims arising from your unlawful use of the service or breach of these terms.
10. General
These terms are governed by the laws of the seller's jurisdiction, and disputes are subject to its courts. You may not assign this agreement without our consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. Questions?
